Time will be accumulated in approximately one-quarter-day fractions without keeping a detailed log.
Retainer: During the initial discussion (normally by telephone) I will endeavor to determine on the basis of non-confidential information whether the case falls within my area of expertise and whether I should agree to assist. If I decide that I should not assist, there will be no obligation on either side beyond any expenses that I was asked to incur. If we agree that I should assist, then the attorney shall purchase an option on my services in this case (usually equivalent to one day's services) in consideration for my promise to assist this attorney, and no other, in this case. If I testify at trial, then the option payment shall be credited against the final billing for this case.
The attorney whom I assist shall guarantee payment of deposition fees and expenses owed by the other side.
Statements not paid in 90 days accrue interest at the rate of 1.5% per month.
